On March 31, 2016, the Commission instituted and simultaneously settled cease-and-desist proceedings (“Order”) against Navistar International Corporation (“Respondent”). In the Order, the Commission found that, from 2011 to 2012, the Respondent made materially misleading statements about its development and manufacturing of exhaust-gas-recirculation-only technology, known as “EGR”, which would comply with the U.S. Environmental Protection Agency’s Clean Air Act standards that became fully effective in 2010. The Commission ordered the Respondent to pay a $7,500,000.00.00 civil money penalty. See the Commission’s order: Release No. 33-10061

The Respondent has paid $7,500,000.00.
