SEC Extends Temporary Principal Trading Rule

On Dec. 28, 2010, the Commission extended a temporary rule -- Rule 206(3)-3T -- that allows advisers, who are registered as broker-dealers, to engage in principal trading subject to certain notice and consent requirements. Without the two-year extension, the rule would expire on Dec. 31, 2010. The extension will allow the Commission to take into account recent legislative developments, as well as its own experiences with the operation of the rule to date. Publication is expected in the Federal Register on Dec. 30, 2010. (Rel. IA-3128)


ENFORCEMENT PROCEEDINGS

In the Matter of Gerard A.M. Oprins, CPA, et al.

An Administrative Law Judge has issued an Initial Decision in Gerard A.M. Oprins, CPA, et al., Administrative Proceeding No. 3-13797. The Initial Decision finds that Wendy McNeeley, CPA (McNeeley), negligently violated Rule 102(e) of the Securities and Exchange Commission's (Commission) Rules of Practice, 17 C.F.R. § 201.102(e). The Initial Decision temporarily denies McNeeley the privilege of appearing or practicing before the Commission as an accountant for one year and dismisses the proceeding as to Respondent Gerard A.M. Oprins, CPA. (Initial Decision No. 411; File No. 3-13797)

The Commission issued notice of a proposed rule change (SR-NYSEArca-2010-116) submitted by NYSE Arca, pursuant to Rule 19b-4 under the Securities Exchange Act of 1934, relating to the listing and trading of the WisdomTree Asia Bond Fund. Approval of Proposed Rule Change

The Commission granted approval of a proposed rule change (SR-NYSEArca-2010-101) submitted by NYSE Arca, under Rule 19b-4 of the Securities Exchange Act of 1934, relating to the listing and trading of the ProShares VIX Short-Term Futures ETF and the ProShares VIX Mid-Term Futures ETF.
