CBI Industries Securities Litigation Disgorgement Fund

April 2000

The SEC has obtained judgment against a number of individuals for engaging in unlawful trading of CBI Industries, Inc. common stock on October 26 and 27, 1995, and a federal district ordered those individuals to disgorge the profits derived through their unlawful trading. These disgorged assets, collected by the SEC, comprise the CBI Industries Securities Litigation Disgorgement Fund (the "CBI Fund").

In January 2000, a federal district court approved a plan proposed by the SEC to distribute the assets in the CBI Fund to persons who were net sellers of CBI Industries, Inc. common stock on October 26 or 27, 1995. The value of the CBI Fund available for distribution to eligible claimants is approximately $1.3 million.

If you sold CBI Industries, Inc. common stock on either October 26 or 27, 1995, you may be eligible to make a claim on the CBI Fund. If you wish to file a claim, you should print out the online proof of claim form (which is a PDF file), fill it out, and mail it to the court-appointed Receiver, Andrew Irving, Esq., at Robinson Silverman Pearce Aronsohn & Berman LLP, 1290 Avenue of the Americas, New York, New York 10104. The deadline for the submission of proofs of claim is June 2, 2000.
