The SEC is part of the executive branch, and only the legislative branch (per the US Constitution) has the ability to write new laws (which is what this rule change really is) that will have such a huge economic impact. Such changes in law must be deliberated within both houses of congress, the public must be widely aware of the proposed changes and their consequences, and the courts must consider whether the changes are constitutional.
