I oppose Proposed Rule Change SR-NSCC-2022-003 as I believe it hurts retail investors by removing responsibility from institutional investors to fulfill their obligation to repurchase shorted securities. The Proposed Rule Change would allow reckless institutional investors to make decisions that threaten the stability of Stock Exchanges, while removing the potential negative consequences for these investors that would normally deter such behaviour.
As a foreign investor that currently holds securities in U.S. companies, if the Proposed Rule Change were to pass I would be unlikely to invest any further money on U.S. Stock Exchanges and I would also strongly consider pulling most of my money currently invested in U.S. companies and instead seek to invest it in other markets.
