 Under the FINRA system, a customer complaint must be disclosed when it is made by the customer.  Oftentimes, registered representatives never get the opportunity to present a defense to the accusation, as the case is settled by either the broker-dealer or insurance company prior to a hearing in front of an arbitration panel.

In the case where a registered rep never gets to defend themselves and a case is settled against their will, it is vital that the rep be given the opportunity to expunge their record - otherwise they are assumed guilty for the rest of their career based on an accusation they never had the opportunity to refute.
