October 31, 2022 The lack of transparency in Swaps allows parties to hide positions certain positions. This results in anything but a fair market. How are investors supposed to make optimal decisions if they're not allowed access to valuable information? Hiding Swap data due to fears or volatility is a malicious act as this allows certain parties to control the price action of securities essentially. This is an extremely flawed design that results in unfair markets and false price discovery. The SEC should also seek to make the penalty for violating this rule harsh as a fine is simply seen as the cost of doing business by large firms.
