 I believe that short selling absolutely and without exception must be disclosed. Short selling in the dark, without disclosure, is predatory, unethical, and antithetical to real price discovery. Companies have the right to know that they are being targeted by short sellers. As a retail investor, I need to know what Im up against, if short sellers are trying to hurt companies I own for their own gain. Short sellers have just as much of a right to short as I do to invest, but they need to be held to an ethical and legal standard of accurate and timely reporting of those positions. Otherwise they might as well be free to manipulate the market as they see fit.
