Dear Chair Gensler,
I'm writing to urge you NOT to walk back your plans to pass a comprehensive corporate climate disclosure rule.
Determining scope 3 emissions will undoubtedly be challenging, but so will a planet with failing crops, cataclysmic floods, fires, drought, and hundreds of millions of climate refugees on the move.
Many legal experts - including one of Justice Gorsuch's former clerks - agree that you have the authority to regulate corporate disclosures, including those related to emissions. In the words of one Penn law professor, "this is core SEC rule-making."
Investors and consumers have a right to know the climate impact of the companies we invest in and whose products we buy. Please require corporations to give investors ALL the information they need to make sound investments.
Sincerely,
