Item 7.01 Regulation FD Disclosure.

Apollo Group, Inc. today reported that the United States District Court for the District of Arizona has denied the motion to dismiss filed by the defendants in the previously disclosed consolidated class action securities litigation. The Company does not agree with the allegations in the litigation and intends to defend itself vigorously.
