On December 30, 2007, Mr. Peltz and Mr. May will receive 666,667 and 333,333, respectively, of those shares as payment, in part, for contractual settlements with Triarc.  The shares deposited into the account for the benefit of Mr. Peltz were previously reported as indirectly owned by Mr. Peltz.</footnote>
