Item 2.05.

Costs Associated with Exit or Disposal Activities.

As previously reported on a Current Report on Form 8-K, dated January 22, 2019, management of Empire Resorts, Inc. (together with its subsidiaries, the “Company”) and Monticello Raceway Management, Inc. (“MRMI”), a wholly-owned subsidiary of the Company, notified employees of MRMI concerning the Company’s plans to cease video gaming machine (“VGM”) operations and food and beverage service at Monticello Casino and Raceway. Such operations ceased on April 23, 2019. The Company estimates the cost of the severance packages offered and accepted by employees of MRMI will be approximately $1.6 million, which represents the total cost the Company expects to incur in connection with ceasing the VGM operations and food and beverage service at Monticello Casino and Raceway.
