     The Men’s Wearhouse, Inc. 401(k) Savings Plan has been amended and restated effective as of April 1, 2007, as set forth in The Men’s Wearhouse, Inc. 401(k) Savings Plan, as amended and restated effective as of April 1, 2007, a copy of which is attached hereto as Exhibit 99.1 and incorporated herein by reference.
