EXPLANATORY NOTE
This Amendment No. 1 to the Jack in the Box Inc. Quarterly Report on Form 10-Q for the quarter ended July 5, 2009 is being filed solely to correct the number of shares of common stock outstanding as of the close of business July 31, 2009 reported on the cover of the document. The number of shares furnished in the original filing inadvertently included shares held in Treasury. We are not amending any other part of the original Form 10-Q filed on August 5, 2009.
