1. On October 27, 2007, this security, which was an option to acquire shares of Series A Convertible Preferred Stock, which in the aggregate were convertible into 93,270 shares of common stock expired unexercised.

2. On March 30, 2008, warrants to purchase an aggregate of 260,036 shares of the registrant's common stock held by Mr. Sternberg expired unexercised.

3. On March 30, 2008, warrants to purchase an aggregate of 308,594 shares of the registrant's common stock beneficially held by Mr. Sternberg expired unexercised.
