(the "Company") issued a press release announcing information relating to the dismissal without prejudice of the class action lawsuit brought by certain purchasers of the Company's common stock (please refer to the Company's Current Report on Form 8-K filed on September 18, 2002 for more information). In the order dismissing the class action lawsuit, the court granted the plaintiffs an opportunity to refile their lawsuit. The plaintiffs reinstated the lawsuit by filing an amended complaint on September 23, 2002. The Company intends to file a motion to dismiss the amended complaint. ITEM 7.
