(a)                                  On May 28, 2009, the Company announced updated efficacy and safety data from its Phase 2 clinical trial of picoplatin in patients with metastatic castration-resistant (hormone-refractory) prostate cancer.  See press release dated May 28, 2009, attached hereto as Exhibit 99.1 and incorporated herein by reference.

 

(b)                                 On May 28, 2009, the Company announced updated clinical data from its randomized, controlled Phase 2 trial of picoplatin in patients with metastatic colorectal cancer.  See press release dated May 28, 2009, attached hereto as Exhibit 99.2 and incorporated herein by reference.
