Item 3.01 Notice of Delisting or Failure to Satisfy a Continued Listing Rule or Standard; Transfer of Listing.
On June 20, 2024, Exicure, Inc. (the “Company”) received a delinquency notification letter (the “Letter”) from the Listing Qualifications Department of The Nasdaq Stock Market LLC (“Nasdaq”) notifying the Company that the Company is not in compliance with Nasdaq Listing Rule 5550(b)(1) (the “Rule”), which requires listed companies to maintain a minimum of $2,500,000 in stockholders’ equity for continued listing. The Company plans to address this additional deficiency in its previously disclosed pending appeal to the Nasdaq Hearings Panel, which is scheduled to be heard on July 9, 2024.
The Company is working diligently to regain compliance with the Rule.
