Item 8.01.  Other Events.

On July 21, 2010, the Dodd-Frank Wall Street Reform and Consumer Protection Act (the “Dodd-Frank Act”) was enacted. Section 1503 of the Dodd-Frank Act requires a Current Report on Form 8-K if a company is issued an imminent danger order under Section 107(a) of the Federal Mine Safety and Health Act of 1977 (the “Mine Act”) by the federal Mine Safety and Health Administration (“MSHA”).

On May 2, 2013, Eastern Associated Coal, LLC (the “Company”), a subsidiary of Patriot Coal Corporation, received an imminent danger order under Section 107(a) of the Mine Act at the Federal No. 2 mine (the “Order”). During an examination of the ventilation system of the Federal No. 2 mine, an MSHA representative detected an accumulation of excess methane in a worked-out gob region of the mine where employees do not work or travel. In addition, the MSHA representative detected an improper reversal of airflow at an evaluation point. The Company took appropriate actions to alleviate the conditions, and normal mining operations resumed shortly afterward. No injuries resulted from the conditions. The Company disputes that the conditions constitute an imminent danger as set forth under Section 107(a) and intends to vigorously contest the issuance of the Order.
