3 To ratify the selection of KPMG LLP as the independent registered public accounting firm for the Company for the year ending December 31, 2010.

BioMarin’s Board of Directors recommends a vote FOR Proposals 1, 2 and 3. If not otherwise directed, this proxy will be voted FOR Proposals 1, 2 and 3 and according to the discretion of the proxy holders for any other matters that may properly come before the meeting or any postponement or adjournment thereof.
