(b) Effective December 31, 2009, Mortimer B. Fuller III is no longer acting in his capacity as Genesee & Wyoming Inc.’s ("GWI") Executive Chairman. Mr. Fuller will continue to serve as Chairman of the Board of Directors of GWI.
