On January 9, 2006, Depomed, Inc. (“Depomed”) filed a complaint against IVAX Corporation in the United States District Court for the Northern District of California for infringement of U.S. Patent Nos. 6,340,475 and 6,635,280, both of which are owned by Depomed.  The patents relate to Depomed’s AcuFormTM delivery technology.  The complaint alleges infringement of Depomed’s patents by IVAX’s extended release metformin hydrochloride tablet.
