VendingData^™ Corporation Prevails In Obtaining Stay To Preliminary Injunction From The United States Court Of Appeals For The Federal Circuit

LAS VEGAS, Nevada (PR Newswire) - March 4, 2005 - VendingData^™ Corporation (AMEX: VNX), announced that, on March 3, 2005, the United States Court of Appeals for the Federal Circuit stayed the preliminary injunction issued by the United States District Court for the District of Nevada pending the disposition of the appeal. The preliminary injunction had prohibited VendingData^™ from selling its PokerOne^™ shuffler during the pendency of the action brought by Shuffle Master, Inc.

Through an action filed on October 5, 2004 in the United States District Court for the District of Nevada (Case No. CV-S-04-1373-JCM-LRL), Shuffle Master alleged that the use, importation and offering for sale by VendingData^™ of its PokerOne^™ shuffler infringed Shuffle Master’s United States Patent No. 6,655,684. On October 14, 2004, Shuffle Master filed a Motion for Preliminary Injunction seeking to enjoin VendingData^™ from selling the PokerOne^™ shuffler in the United States during the pendency of this lawsuit. On November 30, 2004, the United States District Court, District of Nevada, granted the Motion for Preliminary Injunction filed by Shuffle Master, Inc.

In granting a stay of the preliminary injunction, the United States Court of Appeals stated that VendingData has shown the requisite likelihood of success in obtaining a stay of the preliminary injunction, pending appeal. Discovery and a Markman hearing will proceed in the United States District Court while the appeal is pending.
