Item 8.01. Other Events.

Asta Funding, Inc. (the “Company”) has received the previously announced income tax refund from the Internal Revenue Service (“IRS”) in the amount of $52.7 million. The refund amount was the result of loss carrybacks applied to fiscal years 2004 through 2007. Also, as previously announced the Company’s fiscal years 2008 and 2009 are being audited by the IRS.
