(Press Rel. 2000-163) CHIEF ACCOUNTANT IS SEEKING CANDIDATES FOR TWO PROFESSIONAL ACCOUNTING FELLOW POSITIONS The Commission's Office of the Chief Accountant announced that it is now accepting applications for two Professional Accounting Fellow positions in the Office of the Chief Accountant. This highly successful program, begun in 1972, is designed to provide outstanding opportunities for personal development and career advancement. During their two-year term, Fellows work directly with the Chief Accountant, and are involved in the study and development of rule proposals under the Federal securities laws, liaison with professional accounting standard-setting bodies, and consultation with registrants on accounting and reporting matters. The Chief Accountant would like to select individuals with the following backgrounds to begin in June 2001: * One individual with both a background in accounting for financial instruments and experience with financial institutions * One individual for a position which will not be weighted toward a particular background or experience, although familiarity with accounting for consolidations, revenue recognition, business combinations, and other forms of business alliances would be helpful. Applicants should have nine to twelve years of experience in public accounting or its equivalent with at least three to six years as a manager. They should be thoroughly familiar with the technical accounting and auditing literature as well as with current issues confronting the profession. Applicants are required to submit a ten to fifteen page essay they have prepared on their own, on a subject directly related to a current accounting or auditing issue in one of the following topical areas: * Improving the business reporting model * Accounting for overhaul and maintenance costs * Accounting issues involving revenue recognition * Accounting for the carrying value of loans and loan impairment * Determining the fair value of financial instruments that do not have a readily determinable market value, and * Consolidation issues associated with special purpose entities. (Press Rel. 2000-164) DISCONTINUATION OF OFFICIAL SUMMARY OF SECURITY TRANSACTIONS AND HOLDINGS After consultations with other offices of the Commission, the SEC's Office of Filings and Information Services (OFIS) has determined that the Official Summary of Security Transactions and Holdings (Official Summary) should be discontinued, effective March 31, 2000. OFIS reached this conclusion due to the publication's rising costs, limited circulation, and the availability of alternative sources for the information. This notice is to advise members of the public who use the Official Summary that they should make other arrangements for obtaining summary information about the contents of ownership reports filed on SEC Forms 3, 4, and 5, if necessary, prior to the publication's March, 2001 end date. ENFORCEMENT PROCEEDINGS ROBERT MOORE D/B/A THE KINGDOM OF ENENKIO CONSENTS TO A PERMANENT INJUNCTION AND CONTEMPT ORDER The Commission announced that on October 23 Robert F. Moore, individually and doing business as The Kingdom of Enenkio, was permanently enjoined from violating certain of the antifraud and securities registration provisions of the federal securities laws in connection with his Internet offering of bonds. The Commission's complaint, filed on October 5, 2000, alleged that Moore was holding himself out to be the head of state of Enenkio and conducting a $1 billion offering of "Enenkio Gold War bonds." According to the complaint, the Kingdom of Enenkio is not recognized in any international forum as a sovereign state nor is it a corporate or statutory entity. The complaint alleged that Moore's offering materials represented that the bonds paid a compound interest rate of ten percent after 5 years. The complaint also alleged that Moore represented that the bonds were "backed by gold reserves, guarantees, real property or other assets." However, according to the complaint, Moore had no gold reserves and no security, real property or otherwise, for the bonds. The complaint further alleged that the bonds were not been registered with the Commission and no exemption for registration applies. The Honorable Susan Oki Mollway reserved the issue of disgorgement and civil money penalties for determination following the submission of additional evidence. Moore also consented to a finding of civil contempt for violating a Temporary Restraining Order (TRO) issued by Judge Mollway on October 5. The Commission had alleged in its application seeking an order of civil contempt that Moore continued to offer the Enenkio government bonds on his website in violation of the TRO and had failed to provide a sworn accounting as ordered by the Court. In the contempt Order, Judge Mollway ordered Moore to remove the offering from his website within 48 hours and provide an accounting. Judge Mollway ordered that Moore pay a $1,000 fine for each day he fails to comply. Moore consented to the injunctive relief and to the finding of contempt without admitting or denying the Commission's allegations. Haw.] (LR-16780) SEC SETTLES INSIDER TRADING ACTION AGAINST RAYMOND IMP FOR $536,044.24 On October 24, a federal court in New Jersey issued an injunctive Order in an insider trading case filed by the U.S. Securities and Exchange Commission against Raymond A. Imp, a resident of Mount Laurel, New Jersey. Under the settlement, Imp is permanently enjoined from violating the antifraud and tender offer provisions of the federal securities laws and must pay a civil penalty of $252,119. Additionally, Imp must disgorge $252,119 in trading profits plus $31,806.24 in prejudgment interest. Imp consented to the entry of the Order without admitting or denying the allegations in the complaint. The complaint alleges that Imp, in his position as Vice-President of Finance of Interlake Corporation subsidiary Hoeganaes Corporation, received non-public, material information that Interlake might be acquired. While in possession of this information, Imp purchased 68,000 shares of Interlake stock between November 4, 1998 and December 4, 1998. On December 7, 1998, Interlake's acquisition by GKN plc, an English corporation, was publicly announced and Imp's 68,000 shares of Interlake stock gained $252,119 in value.
