David Mobley/Maricopa
Investment Funds Case

On February 23, 2000, the SEC filed an emergency civil enforcement action in federal court charging David Mobley, Sr., Maricopa Investment Fund, Ltd., Maricopa Index Hedge Fund, Ltd., Maricopa Financial Corporation, Ensign Trading Corporation, and other Mobley-related entities with securities fraud.

To date, Mr. Obermaier has distributed over $40 million to eligible claimants. All litigation actions for the recovery of funds have been concluded, and he is confident that there are no further assets to be recovered, or litigations to be initiated for the purpose of recovering additional funds for the benefit of defrauded investors. At this time the Receiver is preparing for a final distribution to investors in one or more of the receivership funds and will be filing the required papers with the court shortly to obtain approval to accomplish that. Shortly thereafter, he will proceed to close this case.
